TERMS OF SERVICE
1. Introduction

Welcome to EatsBueno (“EatsBueno”, “we”, “our”). Our mission is to help you build healthier and more sustainable habits around food, your well-being, and your daily life. To do this, we need to establish certain terms with you.

These Terms of Service (“Terms”) govern your access to and use of the mobile application, website, AI features, community spaces, and all related tools and content (collectively, the “Platform”).

By accessing or using the Platform, you agree to these Terms.
If you do not agree, please stop using the Platform immediately.

EatsBueno Inc. is a wellness technology company registered in the state of Delaware, United States.

By using the Platform, you also agree that any agreement, notice, or communication that we send you electronically (email, in-app notifications, or website notices) satisfies legal requirements for written communication, unless applicable law requires a specific other form.

2. Nature of the Service (Wellness — NOT medical service)

2.1 EatsBueno is a wellness platform and habit-building support system, NOT a medical, clinical, or therapeutic service.

2.2 Nothing on the Platform—including AI-generated messages, food analysis, recommendations, content, tools, or community interactions—should be interpreted as:

medical advice
diagnosis
treatment
prescription
clinical nutritional guidance
therapeutic counseling

2.3 EatsBueno does NOT offer and cannot offer clinical medical or nutritional services.

2.4 You should always consult a doctor or certified healthcare professional for any questions related to your health.

2.5 Use of the Platform is entirely at your own risk.

2.6 You should NOT ignore or delay seeking professional medical care based on information obtained through the Platform.

2.7 If you already have a diagnosis or health condition, you should always follow your healthcare professional’s guidance, treatments, and prescriptions before following any suggestion from EatsBueno.

3. Use of Artificial Intelligence (AI)

3.1 EatsBueno uses advanced AI models to generate answers, analyze food, interpret images, and personalize your experience.

3.2 AI can generate:

inaccurate information
incomplete results
misinterpretations of photos or data
answers that do not apply to your personal situation

3.3 By using the Platform, you acknowledge and accept that:

AI is offered “as is”, without guarantees
AI can make mistakes
You should not use AI-generated information for medical or health decisions.
You assume full responsibility for how you use the information generated by AI.

3.4 EatsBueno does not guarantee the accuracy, reliability or completeness of any AI-generated results.

3.5 You are responsible for critically reviewing the information suggested by AI and deciding whether or not to apply it to your daily life.

3.6 These AI and data-driven features are provided through third-party providers, including OpenAI (language and vision), Google Cloud Vision (image analysis and OCR, where applicable), and FatSecret Platform API (food database search, recipe lookup, and barcode lookup).

3.7 When you use these features, required data may be processed to provide results, such as prompts, food images, food search text, barcode values, locale/language, and requested food/product identifiers.

3.8 This processing occurs only after your action (for example: send message, upload image, start scan, run food search, or barcode lookup).

4. Eligibility and Accounts

4.1 You must be at least 18 years of age to use the Platform.

4.2 If the laws of your country require a different age to give valid consent to online contracts, you must meet that minimum age.

4.3 If you are under 18 years of age (or younger than the legal age of majority in your country), you may only use the Platform with the consent and supervision of your parent or legal guardian, who will be responsible for your use.

4.4 You must provide true, current, and accurate information, and keep it up to date.

4.5 You are responsible for the confidentiality of your login credentials and all activity that occurs under your account. You must notify us immediately if you suspect unauthorized access to your account.

4.6 EatsBueno may suspend or close your account if you violate these Terms or if you pose a risk to the community or the security of the Platform.

4.7 You can request the deletion of your account at any time. Account deletion will result in the loss of access to the Platform and your stored content. EatsBueno may retain certain information for as long as necessary to comply with legal, security, or regulatory obligations.

5. User-Generated Content (Community)

5.1 You can post photos, videos, recipes, comments, or other content (“User Content”). You are solely responsible for the content you post.

5.2 You agree NOT to publish:

offensive, abusive, discriminatory, sexual, violent or illegal content
content that promotes eating disorders, self-harm, or dangerous behaviors
misleading or harmful information
medical diagnoses or content that resembles professional health advice
content that violates copyrights, trademarks, or other third-party rights
personal data of other people without their express consent

5.3 By posting User Content, you retain ownership of your intellectual property rights. However, by uploading or sharing User Content on the Platform, you grant EatsBueno a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, modify, adapt, translate, publicly display, and create derivative works of your User Content solely in connection with the operation, promotion, and improvement of the Platform.

5.4 This license continues as long as your content is available on the Platform and, to the extent permitted by applicable law, is not revoked by the mere deletion of your account if retention of the content is necessary for legal, security or compliance purposes.

5.5 EatsBueno may, at its sole discretion, remove User Content, restrict features, or suspend accounts to maintain a safe environment or if it believes that the content violates these Terms or the law.

5.6 EatsBueno is not obligated to pre-monitor User Content, but may review, moderate or filter content to protect the community and the Platform.

5.7 If you believe that any content hosted on the Platform infringes your copyright or other intellectual property rights, you can write to us at contact@eatsbueno.com including:

your contact details
identification of the content in question
explanation of the right you believe has been violated

a good-faith statement that the use is not authorized

6. Intellectual Property of the Platform

6.1 The Platform, including its software, design, interface, logos, trademarks, texts, graphics, videos, code and other elements (except User Content), is owned by EatsBueno or used under license.

6.2 We grant you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable license to access and use the Platform solely for personal and non-commercial purposes, in accordance with these Terms.

6.3 Unless expressly authorized in writing by EatsBueno, the following is prohibited:

copy, modify or create derivative works of the Platform
distribute, sell, rent, lend or sublicense the Platform or any part thereof
reverse engineer, decompile, or attempt to extract the source code
Use the Platform's content to create a similar or competing service.

6.4 Nothing in these Terms shall be construed as an assignment of intellectual property rights over the Platform in your favor.

7. Privacy and Data Protection

7.1 Your use of the Platform is governed by our Privacy Policy, which explains how we collect, process and protect your personal information.

7.2 EatsBueno will never share your individual personal information with employers, insurers, institutions or organizations that grant you access to the Platform.

7.3 In some cases, EatsBueno may share completely anonymous and aggregated metrics (e.g., total number of active users in a company), without the possibility of identifying you.

7.4 Please refer to the Privacy Policy for full details, including your rights of access, rectification, deletion and objection under applicable law.

7.5 Deleting your account does not necessarily mean the immediate deletion of all your data, as we may retain certain information to the extent necessary for:

to fulfill legal or regulatory obligations
to handle claims or disputes
to prevent fraud and abuse.

8. Prohibited Uses

You agree NOT to:

8.1 Use the Platform for medical, diagnostic or therapeutic purposes;

8.2 Engage in harassment, threats, discrimination, hate speech or harmful behavior towards other users or the EatsBueno team;

8.3 Upload viruses, malware, malicious code or perform activities that compromise the security of the Platform;

8.4 Decompile, disassemble, reverse engineer, extract or copy data from the Platform, except in cases expressly permitted by applicable law;

8.5 Use robots, scrapers, spiders or other automated means to access, collect data or interact with the Platform without prior written authorization from EatsBueno;

8.6 Attempt to gain unauthorized access to systems, other users' accounts or restricted parts of the Platform;

8.7 Use the Platform for commercial purposes without our express written consent, including unsolicited advertising, spam, pyramid schemes or similar;

8.8 Impersonate another person or entity, or falsify your identity or the origin of any communication;

8.9 Infringe intellectual property rights, privacy or any other rights of third parties.

9. Disclaimer of Warranties and Limitation of Liability

9.1 The Platform is offered “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied.

9.2 EatsBueno does not guarantee that the Platform:

be free of errors, interruptions, or technical failures
be available without interruption
be compatible with all devices or operating systems
offer specific results or concrete health improvements

9.3 EatsBueno, its founders, employees, directors and affiliates will NOT be liable for:

direct, indirect, incidental, special, exemplary, punitive or consequential damages
loss of revenue, profits, data, reputation, or business
decisions you make based on information from the Platform
AI errors, misinterpretations, or inaccurate food analysis
actions or omissions of other users or third parties
services, content or links provided by third parties
data loss or backup failures
service interruptions or connectivity problems

9.4 Maximum limit of liability:
In any circumstance, EatsBueno's total liability arising out of or relating to the Platform or these Terms will not exceed the greater of the following amounts:

USD $50, or
the total amount you have paid to EatsBueno (if applicable) in the 12 months prior to the event that gave rise to the claim,
except where applicable law requires a different minimum limit, in which case that mandatory minimum will apply.

9.5 Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such cases, this section will apply to the maximum extent permitted by applicable law.

10. Indemnification

You agree to indemnify and hold harmless EatsBueno, its founders, employees, directors, affiliates, and partners from and against any and all claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

10.1 your use or misuse of the Platform;

10.2 Your User Content;

10.3 any violation of these Terms;

10.4 any violation of applicable law or third-party rights;

10.5 any dispute between you and other users or third parties related to your use of the Platform.

EatsBueno reserves the right to assume, at its own expense, the exclusive defense of any matter subject to indemnification by you, in which case you will reasonably cooperate with us in such defense.

11. Mandatory Arbitration and Waiver of Class Actions (US only)

11.1 This section applies only if you reside in the United States.

11.2 Any dispute, claim or controversy relating to these Terms or your use of the Platform will be resolved by individual and binding arbitration under the laws of Delaware, USA, in accordance with the applicable arbitration rules.

11.3 You waive:

your right to participate in class actions
your right to a jury trial

11.4 The arbitrator's decision will be final and enforceable, and may be presented before any competent court.

11.5 Nothing in this section prevents either party from seeking injunctive or equitable relief in courts when necessary to protect intellectual property rights or confidential information.

12. Applicable Law

12.1 These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules.

12.2 If you are a consumer and reside outside the United States, certain mandatory consumer protection rules of your country of residence may also apply, to the extent that they are enforceable.

13. Modifications

13.1 EatsBueno may update these Terms at any time.

13.2 The current version will be published on this page with the date of update.

13.3 When changes are material, we will endeavor to notify you by email, in-app notification, or prominent notice on the Platform.

13.4 Continuing to use the Platform after the effective date of the changes implies your acceptance of the updated version. If you do not agree, you must stop using the Platform and, if you wish, delete your account.

13.5 EatsBueno may also modify, update, suspend, or remove features of the Platform (including free features or future paid features) at any time. In the event of changes that significantly affect your experience, we will attempt to provide you with reasonable notice.

14. Termination of Service

14.1 We may suspend or close your account, or limit your access to the Platform, if:

You violate these Terms
You publish prohibited or harmful content
You are misusing the AI or the Platform
You create legal, security, or reputational risks for the Platform, other users, or third parties.

14.2 You can stop using the Platform at any time and, if you wish, request the deletion of your account.

14.3 Termination of your account will not affect obligations or liabilities accrued before the termination date (e.g., outstanding claims).

14.4 Some provisions of these Terms will survive termination, including, without limitation, the sections on intellectual property, disclaimer of warranties, limitation of liability, indemnification, applicable law and dispute resolution.

15. Third-Party Services and External Links

EatsBueno uses AI to generate responses, analyze foods and images, and personalize your experience. These features are provided through third-party providers:
• OpenAI (language and vision model processing).
• Google Cloud Vision (image analysis and OCR, where applicable).
• FatSecret Platform API (food database search, recipe lookup, and barcode lookup). When you choose to use these features, required data may be sent for processing (for example: prompts, food images, food search text, barcode values, locale/language, and relevant context). Processing occurs only after your action (for example: send message, upload image, start scan, run food search, or barcode lookup) and after acceptance of the Terms and Privacy Policy. 15.1 The Platform may include or interact with services, content or features provided by third parties (e.g., analytics tools, payment providers, cloud services, social networks or third-party integrations).

15.2 EatsBueno does not necessarily control or endorse these third-party services and is not responsible for their content, accuracy, operation, privacy policies or practices.

15.3 Your use of third-party services is governed exclusively by the terms and policies of those third parties. We recommend that you read those terms before using those services.

15.4 The Platform may contain links to external websites. These links are provided solely for your convenience. EatsBueno is not responsible for the content, availability, or security of such external sites.
15.5 Certain nutrition features may use FatSecret Platform API. Attribution and use are subject to FatSecret Platform API Terms: https://platform.fatsecret.com/terms

16. Electronic Communications

16.1 You agree to receive electronic communications related to your account, security, legal notices, Platform updates and changes to these Terms.

16.2 These communications may include emails, push notifications, in-app messages, or website notices.

16.3 Some communications are strictly operational or legal in nature and you cannot opt out of receiving them (for example, security notifications or relevant legal changes).

17. Export Control and Legal Compliance

17.1 You acknowledge that the Platform may be subject to export control laws and regulations and economic sanctions of the United States and other jurisdictions.

17.2 You agree not to use the Platform in countries subject to embargo or broad sanctions by the United States or other competent authorities, or on behalf of persons or entities included on lists of sanctioned persons.

17.3 You are responsible for complying with all applicable laws related to your access to and use of the Platform in your jurisdiction.

18. Partial Nullity

18.1 If any provision of these Terms is deemed illegal, invalid or unenforceable, such provision shall be enforced to the maximum extent permitted and the unenforceable part shall be deemed severable from these Terms.

18.2 The remainder of the Terms shall remain in full force and effect.
